1. Introduction Welcome to Cybersalt Consulting Ltd. By accessing and using our services, you agree to comply with and be bound by these Terms of Service. If you disagree with any part of these terms, please do not use our services.
2. Services Provided We provide web development, design, hosting, and related digital services ("Services"). Specific terms and agreements related to each service will be provided in the project proposal or contract.
3. Client Responsibilities Clients agree to provide necessary content, images, and relevant project details in a timely manner. Delays in providing requested materials may affect project timelines and costs.
4. Payments and Fees A 50% non-refundable deposit is due upon project acceptance. Remaining payments are due upon project milestones or completion, as outlined in each contract. Late payments are subject to a 5% monthly late fee.
For invoices amounting to more than $500, a 3.5% charge will be added if the payment is made by credit card or PayPal. This charge does not apply to payments received via bank transfer in Canada, the United States, the UK, or the European Union. Please inquire about bank transfer options for other countries to avoid this fee that is charged to us by the credit card companies / PayPal.
5. Revisions and Approvals Projects include a set number of revision rounds, as specified in each contract. Additional revisions may incur extra fees. Clients are responsible for reviewing and approving all project stages. We are not responsible for errors once client approval is given.
6. Website Client Feedback We have a very wonderful and powerful tool we install on client sites that allows you to view your web page and make notes and comments and then submit them directly to our task management workflow, making receiving and acting on your feedback highly time efficient. Our quotes factor in that this tool will be used for sending us feedback. We will show you how to use this. If you choose to not use this tool, we will invoice you for the extra time it takes to try and understand what you are communicating through other methods (i.e., text descriptions in emails, screenshots taken by cell phone, partial screenshots that do not contain all the info we need).
7. Web Hosting Policy Clients are welcome to utilize their own web hosting services instead of the hosting provided by our company. However, please note that if your chosen web hosting service is slow, improperly configured, or requires communication with the hosting company to resolve issues, additional charges may apply. These charges cover the extra time and effort required to address issues that arise from using third-party hosting services. For a smoother experience and to avoid potential additional costs, we recommend using our hosting services, which are optimized for the best performance and support for everyday cases, as well allow us full access to create custom solutions for unique needs.
8. Discontinued Components URL Redirection When migrating from one Joomla version to a higher one, some extensions will no longer work (i.e., K2 was discontinued and does not work on anything higher than Joomla 3). This can cause a very big change in the formatting of the URLs of existing content and required redirects to be created. If this work is not specifically included in a quote we give you, it will be invoiced separately based on the time it takes to create the redirects. In all cases, we are happy to show you how you can do this work yourself!
9. Intellectual Property All deliverables remain the property of Cybersalt Consulting Ltd. until final payment is received. Upon full payment, clients receive rights to the deliverables as per contract terms.
10. Privacy and Confidentiality We respect client confidentiality and will not disclose sensitive information to third parties. Please review our Privacy Policy for more details.
11. Data and Backup Responsibility Clients are responsible for maintaining up-to-date backups of their accounts and data. Cybersalt Consulting Ltd. is not liable for data loss or corruption resulting from client actions, third-party issues, or any other causes.
12. Termination and Cancellation Either party may terminate the contract with written notice. Fees for work completed will be due at termination.
13. Liability We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
14. Governing Law These Terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the jurisdiction of Victoria, British Columbia.
